Issues to Consider as You Prepare for Divorce
Much of our time in our family law division is spent on divorce. This is the most common family law issue—after all, close to half of marriages end in divorce. Whether you and your spouse are in agreement on ending your marriage or you’re expecting a contentious fight, you can rely on us to handle your divorce issues efficiently and compassionately. Some of the key issues you’ll need to settle with your ex-spouse in a divorce include:
- Division of assets and debts: This is one situation where having more money isn’t always a good thing. The more a couple has, the harder it is to divide it all up. A couple with limited assets may just leave the marriage with what they had beforehand, while a couple with substantial assets may have a long list of properties and assets to work through. Colorado, like many other states, is an equitable distribution state. The goal of the court is to distribute assets in a fair way, even if that means it’s not equal. Assets to think about as you prepare include the marital home, vacation properties, retirement accounts, checking and savings accounts, college savings accounts, and vehicles.
- Child support: Child support usually follows a basic formula in Colorado, but it’s not uncommon for couples to agree on a different amount that provides for their children and supports both parties’ budgets. The Court may sign off on the parties’ agreement even if it’s different from the child support worksheets if the court finds there is a sufficient legal basis and it’s in the best interests of the child/children.
- Child custody: Colorado refers to child custody as “parenting responsibilities,” using “parenting time” in lieu of physical custody and “decision-making responsibility” instead of legal custody. At all times, the legal standard is what is in the the best interests of the child. As you negotiate, remember to think about school breaks, holidays, birthdays, and other days that will fall outside the typical schedule.
- Spousal support: While spousal support isn’t always awarded in Colorado divorces, it may be relevant to your case if there’s a major income disparity and the marriage is at least 3 years.
