Divorce is a little different in every state, and as a Colorado resident, it’s important that you know what to expect during this process. Some of the most important things to remember include:
- Colorado is a no-fault state: Only a handful of states still have fault divorce. Fault divorces allow one party to seek divorce because of the other spouse’s abandonment, addiction to drugs or alcohol, infidelity, or other specific issue. These cases generally take more time but may benefit the innocent party. Colorado, on the other hand, only has no-fault divorce. This approach takes less time and may lead to a smoother coparenting relationship.
- There is a waiting period: There is a 91-day waiting period before a divorce can be granted. This time starts either when both parties file the divorce petition together or when the non-filing party is served with paperwork. This isn’t an issue for most, as the majority of divorces take more than 91 days to settle.
